Mobile Application Privacy Policy for Vet2Pet Mobile Application
This privacy policy governs your use of a software application (“Application”) on a mobile device that was created by Premier Vet Alliance. The Application includes an electronic diary a User can maintain about their pets and a link to their veterinary centre (especially including medical or other appointments, health reminders and various information).
1- What information does the Application obtain and how is it used?
1.1 - User Provided Information
Registration with us is required in order to be able to use the basic features of the Application. When you register with us and use the Application, you provide your name and email address. We may also use the information you provided us to contact you from time to time to provide you with important information from your veterinary centre and required notices.
Upon sign-up, in addition to the details provided to us directly or indirectly as above, we will then collect further details from you including details about your pet (such as their type, gender, breed, date of birth, weight and whether they are neutered or not).
1.2 - Sharing information with third parties
We shall not pass your information to any third party (other than as described in this paragraph). Your information may be shared with the following third parties:
2- What are my opt-out rights?
Opt-out of all information collection by uninstalling the Application – You can stop all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.
Account deletion
If at any time you wish to delete all of the information linked with your account, you can do so directly in the Application in the My Account section. You will have a delay of 7 days to change your mind. Past that delay, all your personnel information will be deleted from our system.
3- Data Retention Policy, Managing Your Information
We will retain User Provided data for as long as you use the Application and for a reasonable time thereafter. Please note that some or all of the User Provided Data may be required in order for the Application to function properly, and we may be required to retain certain information by law.
4- Security
We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorised employees and contractors who need to know that information in order to operate, develop or improve our Application. Please be aware that, although we endeavour to provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.
6- Changes
This Privacy Policy may be updated from time to time for any reason and we will notify you of any changes to our Privacy Policy by posting the new Privacy Policy in the Application. You are advised to consult this Privacy Policy regularly for any changes. If you do not wish to accept the new Policy you should not continue to use the Application. If you continue to use the Application after the date on which the change comes into effect, your use of the Application indicates your agreement to be bound by the new Policy.
7- Your Consent
By using the Services, you are consenting to our processing of User Provided and Automatically Collection information as set forth in this Privacy Policy now and as amended by us. “Processing,” means using cookies on a computer/hand held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information.

GENERAL TERMS AND CONDITIONS FOR USE OF THE Vet2Pet WEBSITES AND MOBILE APPLICATION

Definitions:
GTCU: refers to these General Terms and Conditions for Use.
Information: refers to all the information, documents and publications accessible via the Vet2Pet Websites and the Vet2Pet Mobile Application.
Intellectual Property Rights: refers to all intellectual property rights (including, but not limited to, trademarks, designs and models, patents, copyrights) with respect to the Vet2Pet Websites and the Vet2Pet Mobile Application.
Vet2Pet Websites: refers to the following together:
‐ Publisher's website,
‐ Publisher's website adapted to formats suitable for mobile devices (such as smartphones and tablets).
Vet2Pet Mobile Application: refers to Publisher's program, which is downloadable and executable from a mobile device operating system (such as a smartphone or tablet).
Password: means the succession of characters that a User must keep secret and which, along with their Username, allow the User to access their account.
Publisher: refers to the company MEDI-PRODUCTIONS.
Services: refers to all the free or paid online services, relating to the health and well-being of pets, offered to Users on the Vet2Pet Websites and the Vet2Pet Mobile Application, which may include:
‐ An electronic diary a User can maintain about their pets (especially including the medical or other appointments, the purchase of Products or Services on the Vet2Pet Websites and the Vet2Pet Mobile Application or offered by the partners of Publisher, health reminders and information);
User(s): refers to internet users, pet owners, who make use of the Publisher's Vet2Pet Websites and Mobile Application.
Username: means the e-mail address required to identify a User on the Vet2Pet Websites and on the Vet2Pet Mobile Application in order to access a User’s account.
These GTCU are intended to define the terms and conditions according to which, on the one hand, the Publisher makes the Vet2Pet Websites and the Vet2Pet Mobile Application available to Users, and, on the other hand, the manner in which Users access the Vet2Pet Websites and the Vet2Pet Mobile Application and use the Services.
Any use of the Vet2Pet Websites and to the Vet2Pet Mobile Application is subject to compliance with the GTCU.
When registering, Users must ensure that they have read these GTCU thoroughly and accepted them. To validly accept these GTCU, Users must check the box "I declare that I am over the age of 18 and have read and accepted the general terms and conditions for use of Vet2Pet.”
Article 1: Purpose of the Vet2Pet Websites and the Vet2Pet Mobile Application
1.1 The purpose of the Vet2Pet Websites and the Vet2Pet Mobile Application is to enable access to the Services.
Article 2: licence to use
2.1 The Publisher grants User a revocable, non transferable, non-assignable, non-exclusive licence to use the Vet2Pet Websites, the Vet2Pet Mobile Application and Services in accordance with the terms and conditions set forth herein.
2.2 This licence does not allow User to use the Vet2Pet Mobile Application on any device that User does not own or control, and User may not distribute or make the Vet2Pet Mobile Application available over a network where it could be used by multiple devices at the same time.
2.3 Users may not rent, lease, lend, sell, redistribute or sublicence the Vet2Pet Mobile Application. User may not copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Vet2Pet Mobile Application, any updates, or any part thereof (except as and only to the extent any foregoing restriction is prohibited by applicable law or to the extent as may be permitted by the licensing terms governing use of any open sourced components included with the Vet2Pet Mobile Application).
2.4 The terms of these GTCU will govern any upgrades provided by the Publisher that replace and/or supplement the original Vet2Pet Mobile Application, unless such upgrade is accompanied by a separate licence in which case the terms of that licence will govern.
2.5 The Publisher reserves the right to modify these GTCU at any time without notice.
Article 3: Registration on the Vet2Pet Websites and the Vet2Pet Mobile Application
3.1 In order to use the Vet2Pet Websites and the Vet2Pet Mobile Application, Users must register and make a payment.
3.2 Users must download the application from the Apple Store or Google Play platforms before they can register and access all the services offered on the Vet2Pet Websites and the Vet2Pet Mobile Application.
3.3 To register, a User must complete an online form in which they provide data enabling them to be identified (first and last name(s), marital status, email address, phone number) and information about their pet. Each User must choose a Password and User Name in order to open an account on the Vet2Pet Websites and the Vet2Pet Mobile Application. Each User must validate the online form and read these GTCU before confirming that they agree to them by checking a box. Once the form is validated and the GTCU have been accepted, each User must check and confirm all of this information one more time. Once this is done, a User's account is created and a confirmation email for the creation of the account is sent to the User.
Article 4: Access to the Vet2Pet Websites and the Vet2Pet Mobile Application
4.1 The Vet2Pet Websites and Vet2Pet Mobile Application are intended to be accessible 24/7, except in cases of force majeure or the occurrence of an event that is beyond the Publisher's control, and subject to any breakdowns and maintenance operations, updates and technical improvements of the Vet2Pet Websites and the Vet2Pet Mobile Application intended for the uninterrupted operation of the Vet2Pet Websites, the Vet2Pet Mobile Application and Services. However, the Publisher does not guarantee that the Vet2Pet Websites and Vet2Pet Mobile Application will, in fact, be available to Users at all times.
4.2 Maintenance work, updates or technical improvements may be undertaken at any time, without notice to User, and the Publisher may suspend and/or temporarily or permanently modify access to and/or use of the Vet2Pet Websites, the Vet2Pet Mobile Application and Services at any time for any reason.
4.3 The Publisher shall not be held liable for any User’s inability to access or use the Vet2Pet Websites, the Vet2Pet Mobile Application or the Services for any reason. The User agrees to indemnify and hold the Publisher harmless in the event of any liability accruing as a result of the inability to be able to access any service or resulting from any assistance provided by any third party provider of information through the Vet2Pet Websites, the Vet2Pet Mobile Application or the Services.
4.4 By downloading and installing the Vet2Pet Mobile Application, User agrees that the Publisher and its partners may collect and use technical data and related information, including but not limited to technical information about each User’s device, system and application software, and peripherals, that is gathered periodically to facilitate the provision of updates, product support and other services to User. The Publisher and its partners may use this information, as long as it is in a form that does not personally identify any User to any party to improve its products or to provide services or technologies to Users.
Article 5: Responsibility of the Users
5.1 The equipment and material means enabling access to the Vet2Pet Websites, the Vet2Pet Mobile Application and the Services are the sole responsibility of the Users. Users shall bear the telecommunications costs involved for accessing and consulting the Vet2Pet Websites, the Vet2Pet Mobile Application and the Services.
5.2 Users are solely responsible for their computer hardware, data and software as well as for connecting to the network allowing them to have access to the Vet2Pet Websites, the Vet2Pet Mobile Application and the Services. Users are solely responsible for ensuring the compatibility of their computer hardware and equipment, software and connection to the Vet2Pet Websites, the Vet2Pet Mobile Application and the Services.
5.3 Use of the Vet2Pet Websites, the Vet2Pet Mobile Application and the Services implies that Users are aware of and accept the characteristics and limitations of the Internet and operating systems of the Vet2Pet Websites and Vet2Pet Mobile Application. As such, the Publisher shall not be held liable for:
‐ malfunctions in the Users' Internet connection,
‐ the response time to consult, examine or transfer information,
‐ interruptions in service due to the limitations of the Internet;
‐ the lack of protection of certain data against misappropriation, intrusion and the risk of contamination by viruses circulating on the Internet, or hacking.
5.4 It is the User's responsibility to take all appropriate measures so as to protect their data, programs and files. Therefore, the Publisher shall not be held liable for any damage to hardware, software or data that the User may suffer due to the use of the Vet2Pet Websites, the Vet2Pet Mobile Application or the Services.
5.5 Users are solely responsible for updates to the successive versions of the Publisher's Mobile Applications.
5.6 Users are responsible for the use of any third-party sites to which they may have had access through the Vet2Pet Websites and the Publisher's Vet2Pet Mobile Application. Whenever Users access and use third-party websites, they shall comply with the general terms and conditions for use of those websites and the Publisher shall not be responsible for the content of any third-party websites.
5.7 Users who establish a hyperlink to the Publisher's Vet2Pet Websites and the Vet2Pet Mobile Application recognize the Publisher's right to demand that it be deleted for any reason or no reason at Publisher's sole discretion. Users who wish to publish a hyperlink on other websites redirecting to the Services offered on the Vet2Pet Websites and the Vet2Pet Mobile Application and which are reserved for their own personal use and/or whose access is restricted and requires payment, must obtain prior authorization from the Publisher.
5.8 Users agree not to interfere with or disrupt the Vet2Pet Websites and the Vet2Pet Mobile Application in any way whatsoever, including by transmitting content that contains computer viruses or other malicious programs or, in general, by engaging in any activities that constitute cybercrime.
5.9 Users agree not to impersonate any individual person or entity both during the registration stage as well as when using the Vet2Pet Websites and the Vet2Pet Mobile Application, or otherwise engage in any fraudulent conduct while registering with, or using, the Vet2Pet Websites and the Vet2Pet Mobile Application.
5.10 Vet2Pet Websites and the Vet2Pet Mobile Application are subject to US and International Copyright law. All rights are reserved worldwide.
Article 6: Intellectual property
6.1 The general structure of the Vet2Pet Websites and the Vet2Pet Mobile Application, as well as their text, graphics, images, audio and video components, are the property of the Publisher or its partners, and over which said Publisher and partners hold the Intellectual Property Rights.
6.2 Any representation and/or reproduction and/or partial or total use of the content and services offered by the Vet2Pet Websites and the Vet2Pet Mobile Application, by any means whatsoever, without the Publisher's and/or its partners' prior written authorization, is strictly prohibited and may constitute an infringement under Articles L. 335-2 et seq, L.515-1 et seq, L.521-1 et seq, L.615-1 et seq, L.615-12 et seq, and Articles L. 716-1 et seq of the French Code of Intellectual Property.
6.3 Users are not authorised to reproduce, represent or market any such content except in the following, limited cases:
‐ private copy (you can print the pages of the Vet2Pet Websites and the Vet2Pet Mobile Application for your own personal use);
‐ representation within the context of the family circle (Users can represent the pages of the Vet2Pet Websites and the Vet2Pet Mobile Application in a family or friendly context).

Article 8: Applicable law
8.1 Any dispute related to the interpretation and the implementation of these GTCU shall be subject to French law.
8.2 In the event of dispute, notably on the interpretation or implementation of these GTCU, it is agreed that the Users and the Publisher shall consult with each other in order to reach an amicable agreement.
8.3 To this end, the Publisher offers Users a customer service department, which can be reached as follows:

- By ordinary mail at the following address: MEDI-PRODUCTIONS, 5 rue Sainte Claire, 87000 Limoges, FRANCE
- Failing an amicable agreement directly with the customer service department of the Publisher, or in the absence of a response from this department within a period of two months, the User may submit the dispute to an arbitrator who will try to reconcile the parties with a view to reaching an amicable resolution.
The Publisher and User remain free to accept or reject the use of arbitration and, in the case of using arbitration, to accept or reject the resolution proposed by the arbitrator.
8.4 Failing amicable resolution, any challenge or dispute concerning the interpretation and/or implementation of the GTCU shall be brought before the court in the defendant's place of domicile.
8.5 If any provision of these GTCU are deemed invalid or unenforceable under any law, regulation or following a final court decision, such provision would be deemed unwritten and the other provisions would remain in force.
8.6 USER EXPRESSLY ACKNOWLEDGES AND AGREES THAT USE OF THE Vet2Pet WEBSITES AND THE Vet2Pet MOBILE APPLICATION IS AT USER’S SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY AND EFFORT IS WITH USER.
8.7 EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, IN NO EVENT SHALL PUBLISHER BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO USER’S USE OR INABILITY TO USE THE Vet2Pet WEBSITES AND THE Vet2Pet MOBILE APPLICATION, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT OR OTHERWISE). SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE FOREGOING LIMITATION OF LIABILITY MAY NOT APPLY TO CERTAIN USER UNDER SPECIFIC CIRCUMSTANCES.
8.8 In no event shall Publisher’s total liability to any User for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of fifty dollars ($50.00).
Article 9: Termination
This licence is effective until terminated by the Publisher. User’s rights under this licence will terminate automatically without notice from Publisher if User fails to comply with any term hereof. Upon termination of this licence, User shall immediately cease all use of the Vet2Pet Websites and the Vet2Pet Mobile Application.
